There is often confusion between Personal Injury law and Workers’ Compensation law. Unlike Personal Injury law, if you are injured while working for your employer, you will automatically be entitled to private (or semi-private) insurance disability benefits.  In California, employers are required to carry Workers’ Compensation insurance, or qualify for self-insurance to cover such injuries. This may cover benefits for lost earnings during recovery from an injury, medical treatment, and compensation for a permanent impairment or disability.

While the Workers’ Compensation system in California is “no fault”, the likelihood that an employers’ insurance rates increasing with every claim is high.  While some workers’ compensation claims are processed without challenge, it is imperative that injured workers seek the advice of legal counsel for the inevitable denial or limitation of benefit requests from the insurance provider.

‘Making a false or fraudulent workers’ compensation claim is a felony subject to up to five years in prison or a fine of up to $50,000 or double the value of the fraud, whichever is greater, or by both imprisonment and fine.’ [Lab.C. § 5432(a)]
